Please read the following Terms and Conditions carefully:

All orders and purchases made through this website www.kiwiplumbingonline.co.nz are subject to these Terms and Conditions outlined below. These Terms and Conditions may change from time to time without prior notice, and at our discretion.

By placing an order for a product on this website you (The Buyer) accept and agree to abide by these Terms and Conditions.

Orders are accepted for purchases and deliveries within New Zealand only.

1.0 Product Availability

1.1 Kiwi Plumbing Online Ltd cannot guarantee product availability and products, nonetheless, these items may not be available for immediate delivery. Kiwi Plumbing Online Ltd reserves the rights, without liability or prior notice, to revise, discontinue, or cease to make available any or all products or to cancel any order. If there is any revision, discontinuance, or cessation, we may, in our discretion, ship products which have substantially similar functionality and specifications to the products ordered or cancel your order.

2.0 Pricing

2.1 All prices are in New Zealand dollars (NZD) and include GST (15% goods and service tax).

2.2 All prices are correct at time of publication. Prices may increase and decrease time to time; however we reserve the right to alter prices for any reason.

3.0 Payment Options

3.1 Payment by Credit Card

When you take your shopping cart to checkout, you will automatically be offered the choice of paying by Credit Card via Paymate.

Credit card payments are made through the secure Paymate gateway. Once you confirm your order, you will be redirected to Paymate where you can enter your credit card details directly and pay securely online. Once it's paid, you will be redirected back to our website and receive an email confirmation.

3.2 Payment by direct credit or internet banking

If paying by the way of direct credit or internet banking, when you place your order we will email you the invoice with payment instructions.

4. Delivery and Acceptance

4.1 Our delivery rates are based on the value of the total order.

4.2 Delivery charges are not included in the price listed on the website.

4.3 Delivery normally takes three to seven business days after funds have received and cleared, though this cannot be guaranteed. It depends on the delivery service and availability of the product at the time (product/s could be on the assembly line). Whilst we will try to arrange for delivery within specific time frame, we cannot guarantee it. We cannot accept responsibility for delays that are beyond our control.

4.4 Delivery address must be physical street address; we do not deliver items to PO Boxes or Private Bag Number. Shipping address cannot be changed once order(s) has been shipped.

4.5 Please check your delivery address carefully as we will not be responsible for delivery to an incorrect address. Any costs resulting from incorrect delivery information supplied to us will be borne by the customer. You are responsible for supplying the correct delivery address.

4.6 The goods must be checked immediately on delivery for damage before accepting them. Damaged packing should be checked and noted on the delivery docket. Damaged goods should be rejected. If you sign for the goods as being in good order and condition, no claim for freight damage can be accepted.

4.7 All claims for shortages, damages or losses during delivery must be made to Kiwi Plumbing Online Ltd within 3 days of the date of delivery. No claim for shortages, damages or loss in transit will be accepted unless you notify the damage or loss in transit within 3 days of the delivery.

4.8 Delivery of products are made to New Zealand address only.

4.9 Any overseas orders, please email us to enquiry@kiwiplumbingonline.co.nz for further discussion.

5. Returns Policy

5.1 If an order is not received or if goods is received and it is either damaged or faulty, a return claim Must be filed with Kiwi Plumbing Online Ltd within 3 days from the invoice date. Email details of our claim to claim@kiwiplumbingonline.co.nz.

5.2 Faulty items are subject to the Manufacturer Warranty only and Kiwi Plumbing Online will forward the benefit of those warranties to you without being directly liable.

6. Returns based on change of mind

6.1 The item/s must be returned within 21 days from the invoice date. When returning item/s that aren't faulty, based on change of mind, there will be a re-stocking fee applied to the return. The re-stocking fee can be up to 20% of the purchase price, depending on the manufacturer's terms & conditions. This does not include freight charge.

6.2 On returns based on change of mind, freight is not refunded, and the consumer is responsible for freighting the item/s back-to-base at their cost, in its original sold condition.

7. Color Variation

7.1 Please note that the color of our products represented on your monitor may differ slightly to the physical item. If you have any concerns regarding this, please contact us to discuss further.

7.2 Every effort has been made to represent the colors of our products that appear on this website as a accurately as possible. However, because the actual colors you see depend on the monitor you are using, we cannot guarantee that your monitor's display will be completely accurate.

8. Privacy and Communications

8.1 When you place your order, we collect certain information (e.g. name, address, email address). For details on how we use this information, please read our Privacy Statement.

8.2 To fulfill our obligations to you under these Terms and Conditions we communicate with you by email. You agree to receive communications from us electronically and that electronic communications will satisfy any legal requirement for communications may be in writing.

9. Consumer Guarantees Act

9.1 The guarantees contained in the Consumer Guarantees Act 1993 are excluded where the Customer acquires Products from Kiwi Plumbing Online Ltd for the purposes of a business in terms of sections 2 and 43 of that Act.

10. Limitation and Liability

10.1 Failure by Kiwi Plumbing Online Ltd to enforce any of the terms and conditions contained in these Terms and Conditions shall not be deemed to be a waiver of any of the rights or obligations Kiwi Plumbing Online Ltd has under these Terms and Conditions.

10.2 If any of these Terms and Conditions shall be invalid, void or illegal or unenforceable the validity existence, legality and enforceability of the remaining terms and conditions shall not be affected, prejudiced or impaired.

11 Law and Jurisdiction

11.1 The parties agree that the New Zealand courts have exclusive jurisdiction and that the law of New Zealand shall apply to this agreement.
